1. About these terms
These terms govern access to and use of the public website at https://prepsted.co.uk/, including its public pages, articles, contact form and service-status information.
By using the public website, you agree to comply with these terms. If you do not agree to them, you should not use the website.
These terms are a public-website notice. They do not replace the subscription agreement, application Terms of Use, data-processing terms, privacy information or other documents that apply to a subscribed Prepsted account.
2. Who operates Prepsted
The public website and Prepsted service are operated by Cappuccino Education Ltd, trading as Prepsted.
Company number: 17379337

You can contact us at hello@prepsted.co.uk or through the public contact page.
3. Who the public website is for
The public website is intended principally for schools, multi-academy trusts, education professionals, advisers and other people considering or learning about Prepsted. It is not directed at children.
You may use the website only for lawful purposes and in accordance with these terms. If you use it on behalf of a school, trust, company or other organisation, you confirm that you are authorised to act for that organisation where your actions purport to bind or represent it.
4. Public website and subscribed application
The public website provides general information about Prepsted. Access to the secured Prepsted application is supplied separately under a subscription or other written agreement.
If your school, trust or organisation subscribes to the application, authorised users must read and follow the current Prepsted Application Terms of Use and related privacy, data-processing, security and acceptable-use documents supplied in the customer welcome bundle. Those documents explain what information may be entered into the secured application, who may access it, the parties’ data-protection roles and the controls that apply.
Nothing on this public page changes, expands or overrides those application documents. If there is any conflict concerning use of a subscribed account, the applicable subscription and application documents take priority.
5. Important restriction on personal and confidential information
Do not enter, upload, paste or otherwise send private, confidential, safeguarding or operational information about another person through the public Prepsted website.
In particular, the public contact form and general website enquiries must not contain identifiable information about:
- children, pupils, former pupils, parents or carers;
- teachers, support staff, employees, contractors or volunteers;
- headteachers, executive leaders, trust officers or other senior staff;
- governors, trustees, trust members, directors or committee members; or
- any other individual who has not asked you to provide their information.
Do not submit names, personal contact details, pupil-level information, attendance or assessment records, special educational needs or disability information, health information, safeguarding information, allegations, complaints, employment or performance information, disciplinary information, criminal-offence information, equality information, photographs, identification documents or account credentials.
This restriction does not prevent an adult visitor from providing their own name, professional contact details, role and organisation where reasonably necessary to request information, arrange a demonstration or receive a response.
If you accidentally send information that should not have been submitted, contact privacy@prepsted.co.uk promptly, identify the relevant message without repeating the sensitive information and ask us to review it. We may securely delete, restrict or otherwise handle unexpected information in accordance with applicable data-protection law and our Privacy Notice.
Subscribers should not assume that this public-website restriction describes what may be processed inside the secured application. Before entering any information into a subscribed account, review the Terms of Use and related documents supplied in the Prepsted welcome bundle.
6. Permitted use
Subject to these terms, we grant you a limited, revocable, non-exclusive and non-transferable permission to:

You must preserve any authorship, copyright, trade mark and source notices. Permission to use public content does not give you any right to access or reuse subscription-only application content.

10. Accuracy, inspection information and no professional advice
We take reasonable care when preparing public content, but it is provided for general information only. It is not legal, regulatory, safeguarding, employment, data-protection or other professional advice.
Inspection frameworks, handbooks, guidance and practice can change. You should check current official publications and obtain appropriate professional advice before making decisions that depend on legal duties, regulatory requirements or the circumstances of a particular school or trust.
Prepsted supports professional evaluation and preparation; it does not replace leadership judgement, governance oversight, safeguarding duties, legal advice or direct engagement with the relevant authorities.
We do not warrant or guarantee that use of the website or Prepsted will produce a particular inspection outcome, judgement, grade, assurance conclusion or regulatory result.
11. Independence from Ofsted and other bodies
Prepsted is an independent service. It is not affiliated with, authorised by, sponsored by or endorsed by Ofsted, the Department for Education or any other government, inspection or regulatory body unless expressly stated in writing.
References to official bodies, frameworks or publications are for identification and explanatory purposes and do not imply a formal relationship.
12. Website availability and security
We aim to keep the public website available, secure and accurate, but we do not promise that it will always be uninterrupted, error-free, complete, current or free from harmful code.
We may suspend, withdraw, restrict or change all or part of the website where reasonably necessary for maintenance, security, legal compliance, operational reasons or service improvement.
You are responsible for using appropriate browser, device, network, access-control, backup and security arrangements when accessing the website.
13. Links to and from other websites
The website may link to third-party information and services. Links are provided for convenience and context. We do not control third-party websites and are not responsible for their availability, accuracy, accessibility, security, privacy practices or terms.
You should review the terms and privacy information of any third-party website you visit.
You may link to the Prepsted homepage or another public page in accordance with section 6. You must not establish a link from a website you do not control, conceal the link destination, or present the link in a misleading or unlawful context. We may ask you to remove a link that breaches these terms.
14. Our responsibility to you
Nothing in these terms excludes or restricts liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability that cannot lawfully be excluded or restricted.
If you are using the website for business or professional purposes
To the fullest extent permitted by law, we exclude implied conditions, warranties, representations and other terms that may apply to the public website or its content.
We will not be liable for loss of profit, revenue, business, contracts, anticipated savings, goodwill, reputation, opportunity or data; business interruption; wasted management time; or indirect or consequential loss arising from or connected with use of, or inability to use, the public website.
We will not be responsible for a decision made solely in reliance on general website content, a change in official inspection or regulatory material, third-party content, or damage caused by material introduced through a system outside our reasonable control.
If you are using the website as a consumer
Your statutory rights are not affected. We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for business losses or for loss or damage that was not reasonably foreseeable.
15. Personal information and cookies
Our Privacy Notice explains how Cappuccino Education Ltd collects, uses, stores and protects personal information through the public website. Our Cookie Notice explains the technologies used by the website.
You are responsible for ensuring that you have a lawful basis and appropriate authority before providing another person’s information. The restrictions in section 5 apply even if you believe you have authority, because the public website is not an approved route for operational, safeguarding or sensitive records.
16. Suspension and action following misuse
If we reasonably believe that you have breached these terms, we may take proportionate action, including restricting access, blocking technical traffic, preserving evidence, requesting removal of content or links, contacting the organisation you represent, or reporting suspected unlawful activity.
These steps do not limit any other right or remedy available to us or another affected person.
17. Changes to the website and these terms
We may update the public website and these terms to reflect changes in law, regulation, official guidance, technology, security, our services or business arrangements.
The latest version will be published on this page with an updated date. Changes apply to use of the website after publication and do not retrospectively alter a separate subscription agreement.
18. General legal provisions
If a court or competent authority finds part of these terms unlawful or unenforceable, the remaining provisions will continue to apply.
A delay or failure by us to enforce a provision is not a waiver of that provision or any other right.
These terms do not create a partnership, joint venture, agency, employment or fiduciary relationship between you and Cappuccino Education Ltd.
Except where the law provides otherwise, a person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce them.
19. Governing law and courts
If you use the website for business or professional purposes, these terms and any non-contractual dispute or claim arising from them are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
If you are a consumer, these terms are governed by the law of England and Wales, but you retain any mandatory protections given by the law of the country in which you live.
